Mr. Coulter’s complaint names the following Defendants: 107 Judges up for retention; the Judiciary, comprised of 3600 employees/members and 304 Judges; the radio ad narrator, Governor John Hickenlooper; the Colorado Broadcasters’ Association; several radio stations; the Colorado Supreme Court; and the members of the

SUMMARIZATIONS OF ALLEGATIONS IN ATTACHED COMPLAINT:
1. Violation of CRS § 1-45-108
2. Violation of CRS § 1-45-108(1) & CPF Rules 4.1 and 4.4)
3. Violation of Constitutional Art. XXVIII Section 11.
4. Violation of Constitutional Art. XXVIII Section 2, Definitions of
candidate and candidate commissions proclaiming the judges are not political candidates as defined and they therefore are not required to register with the Secretary of State.
5. Violation of CRS § 1-45-108(3)Failure to register political
candidate campaign with Secretary of State.

This lawsuit includes 306 Colorado Judges and alleges that they broke Campaign Finance Laws in accord with the Colorado Constitution, Article XXVIII and the Statutory Fair Campaign Practice Act. The crux of the suit is that the “Judiciary” placed radio and television campaign ads for their recommendation to either support [107 judges] and non-support [two judges] for Retention on November 8 without Registering with the Secretary of State and without filing reports of donations and expenditures as required by Article XXVIII and FCPA. The trial will be at the Office of Administrative Courts at 1525 Sherman Street but those courtrooms only hold 8 people so we are trying to move it across the street to the old Supreme Court Chambers located in the State Capitol. If you are a citizen of Colorado, you need to read the Complaint and attend the hearing. This case affects everyone that must be in front of a judge.
